Renter terms

MARQUE is a trading name of Marque Drive (a ScaleMBS company), trading as MARQUE. These renter terms apply whenever you reserve or drive a vehicle listed by an operator on the MARQUE marketplace. They apply in addition to MARQUE's general terms of service and the operator's own rental agreement, which you will be asked to sign before pickup.

The minimum age to rent through MARQUE is 25 years old for most vehicles. Certain high-performance or ultra-luxury vehicles have a higher minimum age of 30, as set by the operator and shown on the vehicle listing before you reserve. Operators may also require a minimum length of licensed driving history.

MARQUE uses a tiered renter passport so you verify your identity, license, and insurance once and reuse that verification across the marketplace. Higher passport tiers, reached through a longer positive rental history and additional verification, unlock access to higher-value vehicles and, in some cases, reduced deposit requirements. Passport tier is shown in your account and is never shared publicly.

Before your first reservation, you must complete identity verification through Stripe Identity, which includes a government-issued identification check and a live selfie match. Reservations cannot be confirmed until verification is complete.

You must hold a valid driver's license appropriate to the vehicle class and provide proof of personal auto insurance or accept the operator's offered protection product. Operators may decline a reservation if your license or insurance does not meet their published requirements.

MARQUE charges renters a booking fee, currently 5 percent of the rental subtotal, to cover verification, payment processing, and marketplace support. This fee is shown separately in your reservation total before you confirm.

Most reservations include a refundable security deposit hold placed on your payment method. This hold is a temporary authorization, not a charge, and no funds are transferred to the operator or to MARQUE unless a damage or violation claim is later approved. Authorization holds are released automatically after the rental period ends if no claim is filed, subject to your bank's processing timelines.

Each reservation includes a mileage allowance set by the operator and shown on the listing. Miles driven beyond that allowance are billed at the operator's posted per-mile overage rate, charged after the trip ends.

If an operator reports damage, excess wear, or a traffic or toll violation after your trip, MARQUE will notify you and give you an opportunity to respond before any deposit funds are captured. A damage claim must be substantiated with photos or documentation and is subject to review before approval. Approved claims are charged against the deposit hold, and any remaining balance beyond the deposit may be billed separately.

Cancellations are governed by the operator's selected cancellation policy, described in full in our cancellation policy page, which every listing displays before you reserve.

You may not use a rented vehicle for any illegal purpose, racing or competitive driving, towing, off-road driving unless the vehicle is designed for it, subletting or re-renting the vehicle, ride-share or delivery services, or driving under the influence of alcohol or drugs. Violations may result in loss of your deposit, account suspension, and liability for resulting damage.

You are responsible for inspecting the vehicle at pickup and reporting any pre-existing damage through the MARQUE app before departing. Photograph the vehicle at pickup and return to protect yourself in the event of a later dispute.

You are responsible for the vehicle during your rental period, including damage, loss, theft, and citations incurred during that time, subject to any protection product you purchase and the operator's insurance coverage.

We may update these renter terms from time to time, and will show updated terms before your next reservation if changes are material.
